Thank you to Anthony Salerno for his presentation on “What To Do When the Client Calls From Jail” at last month’s MCLE dinner. It confirmed my suspicion that if a friend or client called me from jail, the best thing I can do is give them Anthony’s phone number and then tell them to keep quiet until he tells them otherwise.

This month, we have another of our own members stepping up to entertain (er... inform us). Richard Lysle will discuss debt collection issues. If you’ve ever gotten a call from a debt collector (as bankrupt- cy counsel I get them all the time) or know someone who has gotten such a call, you know that many of them have no qualms about lying, cursing, threatening or otherwise trying to intimidate their target. I can’t tell you how many people don’t realize that we no longer have debtors’ prisons in this country! Anyway, I think Richard’s presenta- tion will be informative and I’m sure that he has some great war sto- ries. Future MCLE events will include a presentation on negotiation tactics and trial and witness preparation.

We still have members that have not paid their dues for 2012 and who have not turned in the new membership application form identifying their areas of practice and the status of their affiliations with the Los Angeles County Bar Association. We are in the process of updating our on-line Directory prior to preparing a new printed Directory and members who have not paid their 2012 dues or turned in the new application forms may not be listed in the directory when it is completed, so we need to get everyone to submit their application along with their bar dues so that we can update the on-line and print directories. We have been asked by the State Bar of California to bring to our Members’ attention the following notice about the State Bar’s plan to conduct increased audits for attorney compliance with the State Bar’s Mandatory Continuing Legal Education requirements:

I am writing to alert you that the State Bar is taking a more aggressive approach to auditing MCLE compliance than it has historically. All California lawyers need to be aware of this change in the Bar’s MCLE auditing process.

The result of the State Bar’s recent 2011 MCLE audit of one percent or 635 law- yers has confirmed the need for increased auditing. Of the 635 audited attor- neys, 539 provided the necessary documentation showing full compliance. Of


the remaining 96 attorneys, five have been suspended due to their inability to show any compliance. Most of the remaining 91 attorneys had minor reporting deficiencies and received a cautionary letter from our MCLE compliance group about future compliance. Approximately 25 of the 91 are being referred to the Office to Chief Trial Counsel for disciplinary action. Using simple math, we see that 15% of this reporting group were not in compliance.

This result is troubling and reaffirms the action being taken by the State Bar. In 2012, California attorneys can expect that five percent or roughly 3,000-4,000 lawyers to be audited. In 2013, the goal is to audit 10% which translates to 7,000- 8,000 lawyers. Letters requesting proof of compliance for 2012 will be mailed in June.

The message is clear. California lawyers must fulfill and accurately document and report their MCLE requirements. No California attorney should be surprised if their compliance certificate is audited. For more information regarding MCLE requirements and reporting, visit the State Bar’s MCLE web page.
